Welcome to Tags Clinic! These Terms of Service ("Terms") govern your use of our services, including our website, in-person services, "Book Now" appointment scheduling (where offered by a location), and check-in feature (collectively, "the Services"). By accessing or using the Services, you agree to be bound by these Terms.

1. About Tags Clinic

Tags Clinic is an authorized California DMV partner offering vehicle-related services, such as registration renewals, title transfers, vehicle inspections, permits, and additional services like notary public, Live Scan fingerprinting, and passport photos. When you use our check-in feature, you will complete a flow that may include capturing your driver's license or ID information (via barcode or magnetic stripe reader, or manual entry), capturing your registration card or title document as required for the service, reviewing your information, and acknowledging our legal notice and consent (including agreement to these Terms and our Privacy Policy).

2. Eligibility

You must be at least 18 years old to use our Services. By using the Services, you represent that you meet this requirement.

3. Your Responsibilities

You agree to:

• Provide accurate and complete information, including valid VINs, license plate numbers, personal details, and (when required) driver's license or ID, registration card, or title document.
• Use the check-in feature only if you are the vehicle owner or are authorized to act on behalf of the owner (e.g., as an authorized representative).
• Comply with all applicable laws and California DMV regulations.
• Pay all fees associated with premium services.
• Use the Services only for lawful purposes.

You are responsible for maintaining the confidentiality of any account credentials.

3.1 Check-In and Consent

When you use our check-in feature, you will be asked to review and acknowledge our Legal Acknowledgment & Consent, which includes our Driver's Privacy Protection Act (DPPA) notice, consent to the collection and use of your information for DMV services, and agreement to our Privacy Policy and these Terms. By checking the box and clicking "Acknowledge & Submit", you acknowledge and consent and agree to these Terms and our Privacy Policy. We record that consent with a timestamp and related context for compliance purposes. Under the California Uniform Electronic Transactions Act (UETA) and the federal ESIGN Act, this form of electronic consent may have the same legal effect as a written signature where permitted.

4. Services and Fees

• Premium Services: We charge fees for expedited and specialized services (e.g., same-day processing, mobile VIN verification). Fees are disclosed at the time of service.
• Standard DMV Services: Services available for free directly from the California DMV are not covered by our fees.
• Refunds: Refunds are issued only if we are unable to complete a service due to our error. No refunds for completed services or user errors.

5. Appointments and Check-In

• Book Now: When offered by a location, appointments may be scheduled via Calendly or a similar booking tool. You must provide accurate details and arrive on time.
• Check-In: The check-in flow collects your ID information (via barcode or magnetic stripe reader, or manual entry), registration or title documents as required for the service type, and your review and legal consent. You must complete all required steps and provide accurate information. Submitting check-in does not guarantee service completion; in-person verification and document presentation may still be required.

5.1 SMS Communications

By providing your phone number through our check-in or appointment forms, you consent to receive text messages (SMS) from Tags Clinic. These messages may include appointment confirmations, service status updates, and other transactional communications related to your service requests.

• Program Scope: Our SMS program includes transactional service messages (such as appointment confirmations, reminder messages, check-in status updates, and service-completion notifications). We may send marketing or promotional messages only where we have the consent required by applicable law.
• Consent and Records: We maintain records of SMS consent and preference changes (including opt-in, HELP, and STOP events) for compliance and auditing.
• Opt-Out: Reply STOP to any message at any time to unsubscribe. You will receive a one-time confirmation and no further messages.
• Help: Reply HELP for assistance, or contact us at admin@tagsclinic.com.
• Rates: Message and data rates may apply based on your mobile carrier.
• No Third-Party Sharing for Marketing: We do not share your phone number with third parties for their own marketing purposes.
• Service Providers: We may use messaging service providers (including Twilio) to deliver SMS on our behalf under contractual confidentiality and data-protection obligations.
• Carriers: Wireless carriers are not liable for delayed or undelivered messages.

6. Intellectual Property

All content on our website, including logos, text, and designs, is owned by Tags Clinic or our licensors. You may not reproduce or distribute our content without permission.

7. Prohibited Conduct

You may not:

• Use the Services to submit false or fraudulent information.
• Interfere with the operation of our website or Services.
• Use automated tools to scrape data from our website.

8. Limitation of Liability

To the fullest extent permitted by law, Tags Clinic is not liable for:

• Indirect, incidental, or consequential damages arising from your use of the Services.
• Errors or delays caused by the California DMV or third parties.
• Losses due to inaccurate information you provide.

9. Indemnification

You agree to indemnify Tags Clinic against any claims, damages, or losses arising from your misuse of the Services or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Services if you violate these Terms or engage in conduct we deem harmful.

11. Governing Law and Dispute Resolution

These Terms are governed by California law. Any disputes will be resolved through binding arbitration in San Diego, California, except for small claims court matters.

We may update these Terms periodically. Changes will be posted on this page with an updated "Last Updated" date.
